Implementation of the Govt. decision on the recommendations of
Committee on the issue related to Defence Service personnel andServicemen – Minimum guaranteed pension to Pre-2006Commissioned Officers / Family Pensioners. (Circular No 500) & that payable to JCOs/ORs.
As per above PCDA Pension Circular dated 17 Jan 2013 the Minimum Guaranteed Pension to pre 2006 pensioners was notified to be paid from 24 Sept 2012. The UOI had filed a SLP in the Supreme Court against the judgment of the Delhi High Court which had upheld the order of the CAT Tribunal on the subject issue. The SLP was dismissed today 29 July 2013 by the apex court. The HSC upheld the judgment of the Delhi High Court meaning thereby that the minimum guaranteed pension would be payable from 01/01/2006.

This should act as a wake up call for mandarins/ babus of the MOD & they must undertake penance for their acts of omission & commission.It is high time that, now they reconcile to pending cases of Rank Pay & Broad banding of Disability Pension. & other issues.RDOA is doing a wonderful job. We must extend all type of help to them.

@corona8 This is your perception. Very amazing ! Why the hell did they go to HSC if benefits were accruing to them also.
High time Ministry of Defence works for its people - Armed Forces rather than against them. We need to have 50% of officers and clerks in MOD from Armed Forces or CDS to be the Defence Minister for always. Defence Minister job should be held only by professionals.
High time Ministry of Defence worked for the Armed Forces and not as its enemy and we do not have to go to court for every wrong (blatant). MOD should have 50% Armed Forces officers and clerks. CDS should be the Defence Minister as a professional is required at that post.
Hope the order spells out all cases to be paid. For pensioners who expired after 1-1-2006 , their spouse ie the family pensioner must be paid the arrears .
I am not clear whether AF forms part of this decision of HSC. OR we have to file a separate case.

The problem you have cited has also been reported by others. Does it have anything to do with the introduction of 'Actual Qualifying Service' vide some letter issued by GOI in 2009?
If so, providing a link to that letter would be a great help for obtaining views of others.

It is surprising that even after the Honorable Supreme Court has given a verdict on the Pre-2006 Pensioners that their arrears to be paid wef 1-1-2006, the GOI, Min of Def has not yet taken a decision to implement the same. Is there a higher authority to appeal against the GOI in this regard ?

Very 2 surprising that Goi is keeping silent & there is NO notification from MOD. It is a deliberate attempt to harass & humiliate the Armed Forces Veterans. Any other option?
