IV CPC RANK PAY CASE:APPREHENSIONS

There seems to be lot of apprehensions on the final outcome of the case as well as continued 'tarikh pe tarikh'.All probable documentary evidence related to the case and the deduction of the rank pay is with the court. The UOI has filed a affidavit as to the method of fixation as asked by the court. In the so filed affidavit there were lot of mis representations which have been countered by RDOA in the form of counter affidavit.These have already been posted on the website of Navdeep.Readers can refresh themselves.There is nothing more/gimmick which can be produced by UOI.All facts and figures are before the court.The court has to finally decide.The SG has not been appearing for reasons best known to him /UOI.RDOA is hopeful that the case will finally be decided on 18 Jan 2012. It is already a decided case as per the order of 08 Mar 2010 of the court. Final call on the appeal of UOI has to be taken by the court.Beyond that it's beating a dead horse.

The intentions of the central government/MOD are very clear from the very beginning, the way the SG has been taking one plea or the another to delay the matter. All efforts are made to complicate and confuse the issue. There are genuine fears in the mind of effected serving/ retired officers about the final outcome at the apex court.It is high time to strenghen the hands of RDOA who have been single handedly fighting the case with full dedication, which is a costly affair. We have to financially support the RDOA so that best legal brains are hired.It is comforting that Shri Harish Salve and other senior advocates are appearing for RDOA.Maj Dhanpalan has already shown the path therefore we should unitedly pursue the matter without worrying about the time factor. It is time consuming process so we have to wait and watch.

The SG has not been available for reasons best known to him and the MoD. Surely, RDOA and its legal team is aware that there must be some legal remedies to expedite the culmination of the case because many similarly placed officers must have entered the "late/deceased" category and yet more in dire financial states after the OROP has not seen light of day.

The strange aspect is, how can any party get away with a series of 'no-shows' after moving an application for recall of an order of the Hon'ble Supreme Court.
