IV CPC RANK PAY CASE:APPREHENSIONS

There seems to be lot of apprehensions on the final outcome of the case as well as continued 'tarikh pe tarikh'.All probable documentary evidence related to the case and the deduction of the rank pay is with the court. The UOI has filed a affidavit as to the method of fixation as asked by the court. In the so filed affidavit there were lot of mis representations which have been countered by RDOA in the form of counter affidavit.These have already been posted on the website of Navdeep.Readers can refresh themselves.There is nothing more/gimmick which can be produced by UOI.All facts and figures are before the court.The court has to finally decide.The SG has not been appearing for reasons best known to him /UOI.RDOA is hopeful that the case will finally be decided on 18 Jan 2012. It is already a decided case as per the order of 08 Mar 2010 of the court. Final call on the appeal of UOI has to be taken by the court.Beyond that it's beating a dead horse.

IV CPC Rank Pay Case Date

TARIKH PE TARIKH. AGLI TARIKH THIRD WEEK OF JAN 2012.
AS ON 22 NOV 2011
Case came up for hearing today 22 Nov 2011 in Court no 10, the Court of Justice RM Lodha & Justice Goakale. The UOI pleaded that the case has been assigned to the Solicitor General (SG) and he only would deal with the case. The SG was not available hence a fresh date be given. The courts would be closed for winter vacation from 15 Dec 11 to 02 Jan 12. First week of Jan earmarked for MISC cases hence case be listed in third week of Jan 2012.

MOTIVATION FACTOR: BAKRE KI MAA KITNE DIN KHAIR MANAYEGI. EK DIN TO HALAL HONA HI HAI.

SO BE IT SO. JAN 2012 NOT FAR AWAY. CHEERS!

IV CPC Rank Pay Anomaly case Update

The case has been scheduled to be heard on 22 Nov 2011 in the Hon'ble Supreme Court as per the advance listing. As a sequel to the last hearing in which it was stated that all pleadings be completed by 14 Nov 11, RDOA has filed a counter affidivit exposing the blatant lies of the UOI filed in its affidavit. Some of these expose have appeared on Maj Navdeep's site.Needless to say the UOI is misleading the court by comparing higher military scales with lowewr civil scales as is evident from the expose given by Maj Navdeep.

Each ‘Rank’ in the armed forces is a promotion by itself in the pyramidcal hierarchy. In no way two or more ranks can be clubbed in the same scale as has been shown in the illustrations. An attempt has been made by the UOI to mislead the Hon.ble Court. It is not only contemptuous but also malicious to down grade the status and pay and allowances of the commissioned officers of the armed forces and should be admonished vehemently.

We do hope that the Hon'ble Court would be able to see through the game plan of the UOI.

ARMY CHIEF DOB CONTROVERSY

Times Now, last evening discussed about the DOB controversy of COAS, Gen V K Singh. Panelist were Lt Gen (Retd) Hoon, (Retd) Shankar Prasad and Frooq Raza. Gen Hoon said COAS should first resign and then fight for the justice. We beg to differ with him and feel COAS should not resign. He must fight it out. As per Supreme Court's ruling and existing policies School leaving certificate is the proof of Date of Birth. Three retired Chief Justice of India have endorsed the same view. It is very easy to criticize and advise others. We fully endorse the views of Major Raza and suggest that COAS, must knock the door of Court for justice, if required.

Rank Pay Case Update: 01 Aug 2011

The case was heard in the court of Justice Aftab Alam and Justice RM Lodha in court no 10 today ie 01 Aug 2011. The UOI was represented by the new Solicitor General Mr Nariman. He put forth his views for 40 -45 mins on the gambit of IV CPC recommendations and the rank pay deduction and its cascading effect on V & VI CPC with the bogey of 1600cr. There were queries from the court on the 'deduction of rank pay and pay fixation' which did not sound convincing. Senior Advocate for RDOA Shri Mahavir Singh drew the attention of the court to the Govt resolution issued after acceptance of the IV CPC report wherin it has been stated that rank pay would be paid in addition to the pay in the integrated scale.The court seemed to be to get to the bottom of the matter that if rank pay was to be given in addition to the pay in the integrated scale, then why the deduction. The court wanted to hear more on the matter. The case has been scheduled in the week beginning 22 Nov 2011.

Update Rank Pay Case: 11 July 2011

The case came up for hearing today in the court of Justice Aftab Alam & Justice RM Lodha. In the absence of the Solicitor General, since he has put up his resignation, UOI sought fresh date. However Mr Harish Salve appearing for the RDOA and others explained to the court the wrongful deduction of the rank pay in contravention to the recommendations of the IVCPC. The example given by the UOI in its affadivit as asked by the court was argued threadbare and the wrongful deduction was exposed to the court. The point was taken note of by the court.The next date of hearing has been scheduled for 01 Aug 2011.

Interactive session with the Adjutant General

An interactive session was held with the Adjutant General and the Veterans Org on 05 July 2011. It was more related to ECHS for which a seperate post will be given. Some other important issues were also covered. These are:
1.PCDA has agreed to issue fresh PPO to all pre 2006 retirees. The process will take three months time.
2. The AHQ is implementing the judgments given by the AFT relating to pay and allce of the petitioners. DV cases do not fall in this perview.
3. AHQ has taken up case with MoD on the judgment passed by Delhi High court on the issue of review of AFT orders by the Delhi High court since as per AFT Act such cases can only be reviewed in the Supreme Court.
4. AHQ is taking up case with MoD on the implementation of the order on "Broadbanding of Disability pension' to be extended to all affected personnel rather than the individual petitioner who filed the application.

Reminder: IV CPC Rank Pay Anamoly Case

This is to remind the readers, lest they have forgotten, that Rank Pay case, being fought by RDOA on behalf of Officers, is to come up for hearing on 11th July. The case was to be heard on 6th May, but UOI made a mention and request that the Solicitor General would not be available on 06 May 2011, as such fresh date be given. Our Senior Advocate had earlier informed the Court that SG was not appearing for the last four to five hearings; Justice Aftab Alam, therefore, told UOI that this be conveyed to the SG and he should be present at the next hearing. The next date was fixed on 11 Jul 2011.


RDOA has analyzed the earlier judgment and have made a summary on how arrears, if case decided in our favour by SC, will be calculated. These are as under:-

Rank Pay plus DA, depending on your Rank as on 1-1-86 till 31Dec 95

Rank Pay plus DA, depending on your Rank as on 1-1-96 till 31Dec 05

Rank Pay will become 50% on retirement

No additional amount is available on promotion in between the two Pay Commissions as that was granted by CDA(O)

Simple interest @6 % will be admissible on arrears, as per earlier Supreme Court ruling

The above is simply put, but will need tremendous follow up and it is here that the RDOA has an even bigger role, by interacting with CDA(O) and CDA(P), who may back track giving non-availability of info as an excuse. Even if AG’s Br intervenes, it will be a long haul for individual officers, whereas RDOA could get the entire authentication done for its members, having all relevant info.

Presentation on One rank One Pension (OROP)

Presentation was given to the Rajya Sabha Petition Committee under the Chairmanship of Shri Bhagat Singh Koshyari, Member Rajya Sabha on 'One Rank One Pension' on 16 May 2011 by RDOA. The presentation was well appreciated. One of the Committee member remarked as 'Best Explanation' and asked for additional information which would be given by RDOA in few days time after compilation. Update:IV Pay Commission Rank Pay Anomaly Case

It is intimated that the case was heard today ie 24 Feb 2011 in the Court of Justice Shri Aftab Alam & Justice Shri RM Lodha ( Court No 12).There were partial arguments on the pay fixation as per recommendations of the IV Pay Commission. The court has asked UOI to file an affadivit on the pay fixation done for civilian officers drawing the same basic pay as army officers at the time of fixation on 01/01/1986 as recommended by the IV Pay Commission.The next date of hearing has been fixed as 08 Mar 2011.

Update IV Pay Commission Rank Pay Anomaly case

The case was heard on 03 Jan 2011 in the court of Justice RM Lodha & Justice Aftab Alam. The court ordered that the case be put up on 24 Feb 2011 for final disposal.
