IV CPC Rank Pay Case Update as on 22 Mar 12
The next date of hearing of the case has been scheduled for 27 Mar 2012 as per case status of Supreme Court.Item no on receipt of cause list of the day.
I am very conversant with functioning of Supreme Court, I presume that the registrar of the cort if any may be the one who itemises the hearings for the day It may be easy for SG to tie up with the person and make sure on March 27 it will again be listed way below. You know what another date.
Honestly, and I mean no offence to the RDOA's legal team,is it possible for some one to give us a concise reasoning why we are so upbeat? Is it the reasoning in the additional affidavit that is full of holes? What is that secret that we don't know??
The Review Petition in the Vodafone case was discussed and dismissed in chambers by the same Bench - all within a coupld of weeks. We have had Justice Katju recusing himself; Justice Alam going to another Bench and now await the convenience of the SG before "Final Disposal" takes place more than 2 years after the Review Petition was filed.
An Appendix to a 'Backgrounder', floating about on the email circuits along with a "Press Release", purportedly from IESM, states at para 1(c)(ix) that the 6% interest is payable from the date of judgement and not, as is widely believed, from the date of the rank pay due. RDOA could consider clarifying this. Here is a link to the "Backgrounder".
