A 1970/1971 officer would not have become a Lt Col before 1986. If we were following the current time scale formula then it was possible. The 70/71 seniority offr would have picked that rank after 1986.70 seniority were majors in 1986(Arty).

At the hearing on the 13th, would RDOA be heard? If so, in addition to the time extension aspect, would RDOA represent how the GOI letter does not meet the requirements of the judgement?

It is surprising to note that despite giving all the Pay slips from 1986 onwards and working sheet of IV CPC, PCDAO has arbitrary made the drawn statement( before revision) and revised the pay accordingly. It is disgusting to note the attitude and indifference displayed while working out arrears. It seem they have been in a hurry to complete the work without getting into details. Whom should I appch for creating another anomaly. Now they will issue LPC which would also be incorrect. Can some one help????

for rdoa>There is again mischiff/cheating in interest calculation also.Interest at 6% P.A has to be compounded every year-which works out to 51% for 7 yrs from jan 2006 to feb 2013.When these dues of 1986-1995 are being paid after 20 yrs-WHAT IS THE VALUE OF 1990 RUPEE AS ON TODAY???????.therefore go for damages in the contempt petition and penal interest .Also file supplementary/review petition for due rank pay for substantive rank of LT COL by time scale which is 800 and not 600 of lower rank of MAJOR of 11 yrs in 1986 and of MAJOR OF 6 YRS AFTER 1996.

@bala: If the Hon'ble Supreme Court had ruled simple interest be paid at 6% wef 01 Jan 2006, then that's what the Govt. will pay, unless, a subsequent review seeks compounding. In such an eventuality, what would be wrong in asking that each monthly instalment, right from 01 Jan 86, be treated, ex-post-facto, as a subscription instalment for DSOPF? What would be the maturity amount in that case?

Inf 70/71 officers had not been promoted to Lt Col before 1.1.86 68/69 batch officers could have been promoted.
I case RGOA is contesting time extension, we must ask penalinterest till date of payment of arrears after the 12 week given initially.Also ammendments to relevant SAIs not done.
Of course the highlighting of False Affidavits and SGs statements may be highlighted.Regards
We fail to understand as to why RDOA is not spelling out whether we are planning to move the case for contempt of court ? this is very vital issue and I feel all concerned brother offices must be in picture.
Supreme court verdict partially rectified the pay parity and status issue of defense officers only in fourth pay commission award by adding the rank pay in basic pay .As such the pay of Col and status Vis-Vis DIG was restored to pre- fourth commission era. But by not implementing the supreme court verdict in letter and spirit by MOD/GOI the pay sales of defense officers have not been enhanced by the same yard stick by which the civilian counter part scales were revised from IV to V and VI pay commissions thus status and parity in pay has not been resorted to and and it has again incorporated the anomaly.This fact must be brought to the notice of the supreme court as how the government is demeaning the forces.
Isn't it funny in our judicial system that the UOI case will be taken up after the extended date being sought for is already over!!! Hail Indian judicial system...

Only officers commissioned during 66-68 were acting Lt Cols on 01 Jan 86.
The wrong statement of the SG that it would cost the Govt 1600 crores is totally wrong which needs to be highlighted. 50,000 Officers affected in 3 Services average 1,00,000 approx) works out to 500 crores plus interest @6% wef 1.1.2006 about 220 crores ie 720 crores approx only.

The CGDA statement signed by Veena Prasad, Jt CGDA (AT-I) calculated and presented to the HPC that
(1) Revision for 1986 to 1995 + interest till 2010 would be
(a) Pay Rs 13589400000 + 1358940000
(b) Pension Rs 2647700000 + 2647700000
(c) Total Rs 5090000000 + 1114700000 =16237100000

Sir, considering that there were 60000 Officers on the strength of AFs on 1.1.86, the average payout of arrears of pay works out to 226490 plos interest 22649 ( only 10%). the Total of of pension arrears and interest are same. Are both these facts given in the RTI reply possible/correct?. The reply presumably is based on some other calculation and not on what has been actally doled out. Regards

I am 1970 batch Mech Inf offr.My batch picked up selection grade Lt Col in mid 1988.
I have recd a sum of Rs 89684/ rank pay arrears.I have down loaded calculation sheet from the website of CDA (O).
I am holding most of the pay slips wef Jan 1989 till 1996. Older payslips have been destroyed by me.
Perusal of the pay slips revealed that the amount shown in the calculation sheet BEFORE REVISION are much more then what has been paid to me or in the pay slip.
Do let me know if you need any document to support your case.

It may be worthwhile to note that the calculations of 1623 crores arrears were worked out in the affidavit (given sometime in 2010) filed by the government wherein the interest payment were taken to be from 1986 onwards i.e., for 24 years. Yet the RTI has government payments with interest being paid wef 2006 as 1623.7 crores exactly as indicated in the affidavit! Something is not right.
@sanket sudan, please see Aerial View's comment at 8.13. it reads 1.1.1986 to 30.6.2010 and not as you stated. So you are hitting it on the head of the wrong nail - your statement about interest from 2006!
It seems the arrears are being given for the Rank pay only whereas it has its affect on the gratuity,commutation and leave encashment etc.also.This also needs to be projected during the hearing.

An year back I already sent mail to Col Sharma for online transfer of funds. In reply he said; send either money in cash/bank draft. I don’t think RDOA with this attitude can help retired officers. My earnest request to Col Sharma, Secretary RDOA, will you still feel getting cash from the members? Why can’t you have an online account if you really feel of acting on behalf of all retired officers? Why cant you have proper accounting. Are you afraid of audit? Am here to advice in accounting and audit. Let us fight against the evil. Let us not fight among ourselves. RTI Act is sooooooo strong today. Flouting of courts judgments/orders in the jurisdiction of the court can be dealt under RTI Act. The Officer who signed the letter dated 27 Dec 2012 on rank pay implementation has flouted the Honourable Supreme Court Order of 4 Sep 2012. What are you waiting for? The jurisdiction of
Honourbale Supreme Court extends to all parts of the country. Why not the retired officers staying in various districts of the States can appeal and file RTI applications to their DC/DM.. Flouting of Courts judgments/orders are dealt by civil administration in the local areas. As per RTI Act, if you find any one flouting with the Court’s judgment/orders, you are duty bound to inform by an RTI application to the local District Collector/Magistrate. What are we waiting for? I request all the veterans to lodge RTI application to their DC/DM stating that the Honourable Supreme Court Order is flouted by the signing authority of rank pay implementation letter of 27 Dec 2012. Hope all of you understood what I said. Am doing it in Hyderabad what I said above. I don’t know in what way RDOA intends to proceed further. I don’t think Col Sharma; all by alone by himself can proceed further. We the retired officers are there to contribute for our own cause but Col Sharma says “Only Cash/Draft”. Why can’t we have our own account in the name of Retired Defence Officers Association with net banking facility? Col Sharma should comment on this.
