RETIRED DEFENCE OFFICERS ASSOCIATION (RDOA)

MINUTES OF THE ANNUAL GENERAL MEETING HELD ON 25 NOV 2018 AT DSOI DHAULA KUAN, NEW DELHI – 110010 AT 1130 HRS

1.         Annual General Body Meeting (AGM) of the ‘Retired Defence Officers Association’ (RDOA) was held on 25 Nov 2018 at 1130 hrs at DSOI Dhaula Kuan, New Delhi – 110010. House assembled at 1100 hrs, because of lack of quorum it was adjourned for half an hour and reassembled at 1130 hrs. The meeting was attended by 30 officers.
AGENDA POINT NO.1
Welcome address by the President RDOA: Lt Col BK Sharma (Retd)
2.         President welcomed all the members to the AGM. He stated that the last EGM was held on 15 April 2018 and the minutes were posted on our blog on 21 April 2018 for the information of members. He informed the house the state of membership as on 25 Nov 2018.

3.         AGM has been called basically to present and pass the accounts of the FY 2017-18. Adequate publicity was given for this meeting by posting the notice on RDOA’s blog on 04 Nov 2018 and notices were displayed at Base Hospital, ECHS Polyclinics, Army Golf Club, DSOI and at few AWHO Complexes. Points for interactive session received from the members will be discussed during the meeting.
4.          The President said that only important and authentic information is put on association’s blog “rdoaindia.blogspot.com” which is updated regularly. He requested all members to motivate other officers to join RDOA to strengthen RDOA’s objectives.

5.      The President emphasized once again in informing members that not even a single penny has been expended   by any of the office   bearers on transport, telephones, internet and secretarial support from association’s fund which speaks of high credibility and dedication of the team. He informed that RDOA has been successful in winning cases in the Hon’ble Supreme Court. Some of them are:-
        
          (a) 4th CPC rank pay anomaly case.
          (b) Minimum Guaranteed Pension i.e arrears of pension to Pre 2006 Pensioners.
          (c) Broad Banding of Disability Pension (Pensioners who had superannuated).

6.       President then proceeded with the remaining agenda points.

AGENDA POINT NO.2
Confirmation of Minutes of the EGM held on 15 APRIL 2018.

7.      The salient points of the meeting of the EGM held on 15 April 2018 were read out to the members by Secretary Col Rajiv Kakra. There being no observation, the minutes were passed duly proposed by Lt Col VK Ogra (M. No. 1274) and seconded by Maj NK Gadeok (M. No. 1397).

Presentation and Passing of Accounts for FY 2017 - 2018.

8.   President presented the Accounts for the FY 2017- 2018. He further briefed the members on the state of A/c, FD’s and Comparative state of A/c for the last five years.

9.         Col KM Joshipura suggested that some portion of the FDs be also invested in Mutual Funds. The President stated that the finances are being invested as decided by the house. In case any concrete proposal is received in this regard, it will be put before the house for consideration. There being no further query/obsns the Accounts were passed duly proposed by Col Vinay Khanna (M No.  2220) and seconded by Col DM Bahl (M No.  2482)

AGENDA POINT NO.4
Progress of Court Cases

10.    President briefed the members on the progress of the ongoing court cases and various important issues taken up by the RDOA with Govt of India. Some of them are;-
 (a) Increase in Refundable Security, DSOI, Dhaula Kuan in Patiala Court.
 (b) Intervention Applications filed in the following cases:-
         
          (i) Lt Col Karamveer Singh Vs State of J&K & Ors.
          (ii) Neela Ghokhale Vs UOI and Anr. (WP(C) No. CA 1005/2013).
          (iii) Kudat Sandhu Vs UOI & Anr.  (WP (C) No. 279/2017.
          (iv) Dilution of AFSPA ref Manipur CBI Inquiry case.

  (c) Lower Rank Drawing Higher Pension Than Senior:- MOD has agreed and stated that the matter is under examination. In case anomaly is not resolved then a PIL will be filed after consultation with our Lawyers.
  
 (d) Decline in Status & Financial State of Armed Forces Personnel:-  RDOA’s representation has been forwarded by PMO to MoD for action  on 13 Nov 2018. We shall consider filing a IA in a Writ Petition being filed in this regard in The Delhi High Court by an Officer from Panchkula.

11.    On the request from members the President stated that all the above cases will once again be put up on RDOA’s Blog for information.

AGENDA POINT NO.5
Points from Members

12.   Following points were received from members:-
(a)     2563,  Maj RP Sehgal (Retd) ;- The matter should be taken up with appropriate authorities that all Majors with 13 years or more service and retired pre 1996 be given the pension of the rank of Lt Col or let your legal expert advise me the course of action at my end.

Decision

               We will await the outcome of pre 1996 Maj and equivalent getting pension of Lt Col pending in The Hon’ble Supreme Court before deciding the future course of action.
                
        (b) Sqn Ldr CL Bedi (RETD)
(i)      As per Newspaper MoD is likely to withdraw  180 court cases pending in various courts. Kindly elaborate and intimate “which are these cases?”
(ii)    As per Defence Pension Payment Instructions, Payment Registers are required to be retained for ever where as PNB in reply to my RTI have stated that they do not retain any such record beyond a period of 10 years. Kindly take up this case with appropriate authorities to instruct Banks to adhere to the Defence PPI-2013.

Decision   (a) Members will be informed once authentic information is received regarding withdrawal of court cases. (b) Case will be taken up with the appropriate authority regarding case pertaining to PNB.

Vote of Thanks
14.       Meeting was closed at 1300hrs with a vote of thanks proposed by Col VK Sud       (M. No. 434) and seconded by Col KM Joshipura (M. No.  2337). Most of the members got themselves examined by a team of Medicos part of free Health Camp which was Organised by Jeevan Sudharo Welfare Society.
