A letter dated 12 Nov 12 from PS 3 addressed to Pay Cells of AF and Navy seeks clarification as to why the SC judgement should be applicable beyond Dec 95 since no one filed or won any case reg Rank Pay anomaly in respect of 5 CPC. Please ask some one to show you paras 29, 30,31 of the Additional Affidavit filed by the UoI which clearly states that UoI will have to revise pay etc on 1.1.1986, 1.1.1996 and 1.1.2006.
Maybe PS3 would like to be in contempt of court.

Paragraph 30. In these circumstances it is most respectfully submitted that Government of India is fully concerned with the grievances of the armed forces personnel however the order dated 8-3-2010 passed by this Hon’ble Court if implemented would lead to the following practical difficulties:
(a)In the present matter, implementing the Hon’ble Court order dated 8-3-2010 would mean re-fixation of pay of not only the officers entitled to Rank Pay, but pay scales of other personnel above and below such officers would have to be revised w.e.f. 1.1.1986 firstly, and then from 1.1.1996 and 1.1.2006, i.e. at the time of subsequent pay revisions. Similar process would be carried out for revision of pension of the retired personnel. Any changes at one place will inevitably have impact on horizontal and vertical parities thereby changing the overall pay structure by the 4th CPC.
(b)Grant of this unintended benefit would place a heavy burden on exchequer. Para 9 and 10 of the Report (emphasis by deponent) of the High Powered Committee constituted to assess the financial impact is reproduced below for ready reference: -
“9. Apart from the enormous financial implications, actual implementation of the Hon’ble Court’s order would involve the following stages: -
1.Revision of pay of officers on 1.1.1986, 1.1.1996 and 1.1.2006 with simultaneous revision of all pay linked allowances/benefits. Enormous efforts are required to extract data from all backed up resources, including information relating to promotion, annual increment, stagnation increment, details of forfeiture, admissibility, discontinuation of relevant allowances, calculation of Income tax and apportioning the same over the years;
2. Calculation of DA on slab basis from 1.1.1986 to 31.12.1995 is time consuming;
3. Revision of retirement benefits (gratuity, leave encashment) of officers retiring after 1.1.1986;
Revision of pension on 1.1.1986, 1.1.1996 and 1.1.2006;
4. In several cases, family pensions would have to be revised on the basis of revised pay/pension of the officer;
5. In some cases, payments may have to be made to legal heirs of the deceased retired officers; and
Interest at the rate of 6% per annum for upto 24 years in each case will have to be calculated and paid.
6. This would be a protracted exercise taking a lot of time and involving huge manpower as each case will have to be examined/calculated individually.
@young 50.U need not worry about what PS3 has written. Their name will be added in the contempt list.
let me assure u all the commitment is on affidavit and there is no escape route.In fact the minutes have been signed by Def Secy, Secy Def Finance and Secy Expen which has been reproduced in the court affidavit.These are all delaying tactics to buy more time. SG will have to answer. Just be cool!

The point here is not that @Young50is contesting our entitlements as he is merely bringing useful information to the notice of everyone.
The point here is that it is the paycells, to whom the PS3 letter has been written, which need to officially bring the contents of those paras to the notice of PS 3 to nip any mischief in the bud.

I have asked Air HQ (Dte of Accts). They were unaware of that letter. They confirmed only that MoD had sent a FAX asking for DGL to be sent to MoD for further necessary action.
If you consider it useful information, then I shall not argue/discuss further, especially since RDOA has given a succinct reply.
@Air Martial: RDOA also said, "Their name will be added in the contempt list". :-)
So if the info about the letter was good old duff gen being passed, then nothing needs to be added. But even if it was true, it's for the paycells to respond to PS3 and not the person conveying the information about the letter.
That's what I was trying to convey.
PCDA(O) has taken off the scroll a message that it had put on its website regarding rank pay. though the first message put up is still there. Wow. seems they do not know what they are doing.
Period allowed by Hon'ble SC for implementation of its order is 12 weeks (i.e. up to 27.11.12) and NOT 3 months (i.e. up to 4.12.12, as is generally understood). So just one week is left. It appears impossible to implement the order up to ground level within prescribed period.
SC court will also be closed for its winter vacations from 15.12.12 onwards till end of year.
Hope that RDOA is ready for contempt proceedings accordingly.

@CL BEDI: The order, dated 04 Sep 12, actually said "....expeditiously and positively within twelve weeks from today...."
That would mean 26th November is the last date available for ensuring implementation.
What's the latest? DGL stuck in the corridors of South Block, unable to cross Rajpath to North Block?

Hopefully, for the sake of those responsible, 27th Nov, and later, ought indeed prove to be impossible as no one really wishes to see anyone getting booked for contempt.
27th would not be within twelve weeks as ruled by the highest Court in the land.
26th November would be. That date might, therefore, be within the realm of the possible for our esteemed functionaries in MOD.
If 26th is the last date post which contempt can be filed, then orders should be issued in next two days.... since 24th and 25th is sat/sun(holidays)

Probably now CGDA will ask PCDA (O), CDA (N)/NPO and CDA (AF)/AFCAO how much is outgo?
They will pull out their abacus to calculate and revert to CGDA, MoD and MoF. By then 12 weeks will be over.

Meanwhile, It is understood that an appeal (modified parity in case of civilians) by GOI against decision of CAT is listed for hearing in Hon'ble Delhi High Court on 29.11.12.
This case is similar to the one effecting Defence personnel pending in Hon'ble SC and listed for next hearing on 14.1.13.

As per SC, the order are to be positively implemented with 12 weeks from the date of judgement which is a recorded commitment by the SG. RDOA is silent on the cut-off date which should be legally 27 Nov, with two intervening holidays. Looks like it may not be feasible by this date. Felllow blogggers pl do not mistake me for spreading anxiety or pessimism. It is just the eagerness for justice which took 26 years to be delivered. Pl contribute to clear the air !
The new normal in India for 12 weeks is 12++++ weeks. So lets not start counting hours and days. Be thankful if something start happening before year end. I am very optimistic. Of course no harm filing a contempt motion and let it be on record for any future references as this attitudes of babu's will be new normal

My humble suggestion is that we wait and watch what RDOA does next. It fought and got justice for us from the Hon'ble Supreme Court and I am sure RDOA will go one better in case it files Contempt.
Remember what RDOA wrote on 15 Nov - Def Secy, Secy Def/Fin and Expenditure Secy are party to the affidavit in the SC and may not want to appear and be ticked off. And what will such a contempt do to the reputation of the Learned SG?
Just chill and let RDOA do the fighting with our full support.
