Update IV CPC Rank Pay Case


AS ON 28 MAY 2013

COSC REMINDS RAKSHA MANTRI

It is learnt that the Chairman Chiefs of Staff Committee (COSC) Air Chief Marshal NAK Browne, has written to the Raksha Mantri (RM) drawing his attention to the unresolved infirmities, which he had pointed out in his previous letter of  18 Jan 13, becoming a ‘cause of concern’ in the non implementation of the Supreme Court verdict of 04 Sept 2012 in the IV CPC Rank Pay Case inspite of the extension of time limit given by the  apex court till 31 May 13, and the serving of ‘Contempt Notice’ by the Retired Defence Officers Association (RDOA) (litigants)  to the Defence Secretary and others involved in the case leading to unnecessary further litigation and discontentment in the payment of arrears to the veterans. He has requested the intervention of RM for resolution of the anomalies created due to wrong interpretation of the Hon’ble Supreme Court order.

with due respect to efforts of chairman cosc, it appears merely a formality of doing one's bit within the service constraints.However
there is no way short of contempt petition to sort this out

This is a very crucial bit of news, made available to all through the efforts of RDOA.

It would really be interesting to learn whatever details become available in respect of Hon'ble RM's response.

Writing few letters to Defence Minister at this stage may not meet our requirements.Babus in MOD and CDAs are clear in their mind and Defence Minister will ask their advice to reply chairman COSC.So?
Need of the day is contempt petition and clear time frame direction from HSC.

While there is no harm in such activity, this will not result in any worthwhile gains. Getting MOD to somehow see our point of view is a waste of time. We need to go to public rather than to the govt. The campaign to return medals was a good exercise. Now we need to go further. The aim should be to show that we are shifting our strategy and the new one will be bad for the govt.

May have little effect on raksash sorry raksa mantri since he has to go by the policy of the babus and his boss.But no harm if it has been sent.

Ultimate effect will by the contempt case as HSC is not helpless and decides without advice of Babus and raksha mantri's boss.So please pursue the contempt case vigorously.

Thanks God COSC has taken some pain. Unless contempt of court and awareness in depth by media and in public is resorted exhaustively this govt will not do any thing since presently there no vote bank politics is involved

Personally, I think its a bold step that will only add to the weight of the Contempt Petition to be filed by the RDOA soon. It may be taken note of that only RDOA is not resorting to this petition, given that Chairman, CoSC is reported to have written that only CGDA has dug in its heels whereas the MoD has understood the problem created by the MoD letter of 27.12.2012 based on the CGDA draft.

In 1996 Def/Fin deducted the Rank Pay (as per admission obtained under RTI) and questioned by MoF and DOP&T. Now CGDA is determined to protect its turf because of the impugned letter.

I am glad to find that now the younger generation ( Neelam) too has come out in support of def veterans. Thank U Neelam, U should bring more of Ur friends to this forum so that our bone of contention is clearly understood by the civilians also. Only then this Govt will be brought to the knees.

I took premature retirement in March 1993 in the rank of Wg Cdr(S). Revised PPO received on 29th May, 2013 from DCDA (AF) clearly establishes that there is no change in pension for 5th & 6th Pay Commissions viz Rs 7550/- and Rs 25700/- (plus Rs 565/- wef 24 Sep' 12, respectively). Not with standing the on going efforts of Chairman COSC with the RM, the MOD Babus have stuck to their stand and beaten the deadline of 31 May' 13.Actual arrears although are still to be paid by the Bank. I am sure other AF officers would have similarly received their revised PPOs.

Why the contempt notice has not been served on the Defence Minister, as he is equally responsible for failure in implementing the HSC verdict in letter and in spirit. This is in spite of a number of letters and representations sent to him personally by number of serving as well as ESM authorities. I am sure our legal luminaries would consider this aspect in a more judicious manner to initiate suggested action.
Even now this action can be taken.
It would give all of us great satisfaction in seeing the concerned defaulters, behind bars for maximum possible periods. Will our HSC assert its real authority in this case, now at least.
There must still be a large number (in thousands, I presume) of officers like me, who have neither received the Rank Pay arrears nor the enhanced pension wef 24 September 12.
Doesn't it reflect poorly on the the PCDA (O), PCDA (P) and the concerned pension paying banks?

@S Chander:"..clearly establishes that there is no change in pension for 5th & 6th Pay Commissions.."; Even with the shortcomings in the MOD letter for implementing the judgement, some officers will receive arrears for the duration of V CPC depending on when they received their promotions.

Since you retired prior to V CPC, your pension from DOR to 31 Dec 95 would be affected if your last BP was revised upwards as a result of the judgement.

Post V CPC the pension would have been fixed on the basis of the common payband considerations, thus with no-change resulting.

All this would change if the TRIPAS DGL is implemented.

sir, I can vouch....RM will not reply the letter.
Even if he does ,It will be issue type letter stating that we are really concerned & government is looking into the matter, ....

@corona8.." Thanks for your info. I am a keen follower of your blog and admire your appreciation and in depth analysis of various aspects of the subject. As on date the TRIPAS DGL stands rejected and efforts of Chairman COSC do not appear to have borne any visible results. DCDA (AF)appears to have met the dead line of 31st May' 13 by issuing the revised PPOs. One wonders what will be the basis of contempt notice in SC. Differences in perception of SC verdict between CGDA/MOD and TRIPAS may be construed as a new case. It will be a miracle if SC decides to discuss these merits as a part of the current petition. Let us hope for the best.

It is quite surprising that the RM has not bothered to reply to the COSC till date and a reminder had to be sent. This is an insult to tha Complete Armed Forces of India fraternity ans shows the attitude of the Politicians towards the Armed Forces. It is a pity we have to lump it.

Has DCDA(AF) met the deadline as you state? I have it on very reliable inputs that AFCAO have not been able to effect payments to hundreds of IAF veterans even in respect of rank pay arrears, forget about pensions.

This issue had come up on the chatroll and I feel this could be of interest to RDOA and all affected.

What is now required is some form of concerted action to obtain a complete month by month statement of accounts regarding the arrears from the different disbursement agencies.

This would need to be in a tabular form showing the month-wise basic pay and affected allowances that were originally paid and, alongside, the post judgement revised bp and affected allowances and a column showing the arrears for that month.

This would clearly reveal any discrepancies that might have been introduced even within the limited and flawed scope of the implemented revision.

It would also enable individual veteran/serving Officers and RDOA to extrapolate what the month-wise arrears actually ought to be and the degree of shortfall.

The grip vine (no spelling error!) has it that CGDA has been sitting on for 4 weeks on a draft sent by MoD regarding certain recommendations made by TRIPAS.

Now, its funny (only I cannot laugh) that CGDA in its INCOMPLETE reply to my RTI stated that it is only the implementing agency and that MoD is the Competent Authority. Why does the AS (A) of MoD (the Competent Authority) have to refer a draft to the CGDA ( the implementing agency) for whatever reason? Doesn't the MoD have a Secretary level officer, the Secretary Def/Fin, to offer opinions/advice? Or has the MoD less faith in Secy Def/Fin and more faith in the CGDA?
By the way, Hon'ble RM is away in Australiaand hope he will reply to my letter spent by Speed Post on 21.5.2013.
Contempt Petition and why? The payment made is incorrect, the MoD hid from the Hon'ble Courts certain material facts etc etc. That is why .

TRUTH BITES:-
Britishers ruled our country, making rules n regulations best fitting thier requirements as administrators / rulers. that time need of an hour was no accountability of administrator / ruler to the ruled as all rulers were ghoras. Even after 66 years of indipendence these rules are intact as it suits the civil service. subsequent rules were also made by them in thier own intrest. a govt. servant can do any wrong n voilate HSC order and can get away in the name of working for n on behalf of GOI. hence my govt. would be responsible for the mischief of some poluted minds.
It would be very intresting to see the outcome of this whole episode in absence of govt. servant non accountability. in my opinion the law of land will win. It pains to know that a soilder who lend his youth to the country is harrassed like this by selfish dhrohis in our land.

shiva,hi everybody. pcdao does not even indicate when are thay going to pay arrears or certain offrs are not auth as per their calculation. just keeping in dark by saying due and drawn statement will be uploaded soon. this story is going for past four months

RDOA may consider the extracting following info through RTI from CGDA/MOD to make contempt case strong.
(a)Total No of Officers affected and total numbers paid arrears as on 31 May ,may be separately serving / retired.
(b) Total outgo of Rank pay dues as on 31 May 2013and anticipated outgo.
(c) Components of Rank Pay arrears being paid(Rank Pay Yes/ NO,DA Y/N,Encashment of Lve Y/N, Adjustment of Rank Pay to fix pay in subsquent pay commissions Y/N etc...).
(d) The details of arrears given to offrs /posted on web site Y/N.

Data required for calculation of arrears in case of approx. 9000 retired officers, whose IRLA’s are not available in PCDA(O). The action regarding pay revision and remittance of arrears to be expected soon.
